TERMS AND CONDITIONS OF THE UNDRESS CODE ONLINE STORE

Terms of Service

An agreement between the Buyer and the Seller may be concluded in two ways.

Before placing an Order, the Buyer has the right to negotiate all provisions of the Agreement with the Seller, including those modifying these Terms and Conditions. Such negotiations should be conducted in written or documentary form and sent to the Seller’s email address: whatsupbabe@undress-code.com.

If the Buyer waives the possibility of concluding an Agreement through individual negotiations, these Terms and Conditions and applicable laws shall apply.

TERMS AND CONDITIONS

§1 Definitions

Data Controller / Seller – Undress Code sp. z o.o., registered office at ul. Daniłowskiego 7/87, 94-208 Łódź, Poland, VAT ID (NIP): 522-304-30-90, entered into the Register of Entrepreneurs of the National Court Register under number: 0000583525.

Postal Address – first and last name or company name, street, building number, apartment number, postal code, city, and country.

Business Days – days from Monday to Friday, excluding public holidays in Poland.

Delivery – transport service of Goods to the Buyer performed by a carrier selected during the Order process.

Proof of Purchase – fiscal receipt, VAT invoice, or another document confirming the conclusion of the Agreement and payment, issued in accordance with applicable law.

Return Form – a template provided by the Seller to facilitate submitting a withdrawal statement; its use is not mandatory.

Consumer – a natural person entering into a legal transaction with the Seller not directly related to their business or professional activity.

Account – a Store functionality (if available) enabling the Buyer to use additional features after providing required data and logging in.

Cart – a Store functionality allowing the Buyer to compile selected Goods before placing an Order.

Buyer – a Consumer or a natural person concluding an Agreement directly related to their business activity, provided that it does not have a professional character for that person (in particular based on business activity registered in CEIDG), if mandatory law grants them consumer-like protection.

Newsletter – an electronic service consisting of sending commercial, marketing, or brand-related content about Undress Code, provided the Buyer has given separate consent.

Payment – the method of fulfilling the monetary obligation under the Agreement.

Product / Goods – a movable item presented in the Store that may be subject to an Agreement.

Terms and Conditions – these Terms and Conditions of the online store.

Store – the online store operated by the Seller under the domain undress-code.pl and its relevant subdomains.

Goods in Conformity with the Agreement – Goods compliant with the Agreement in accordance with applicable law, especially consumer rights regulations.

Agreement – a distance sales contract concluded between the Buyer and the Seller via the Store.

Electronic Service – a service provided electronically by the Seller via the Store, including Account management, Order form, Cart, or Newsletter.

Order – a declaration of intent by the Buyer to conclude an Agreement, specifying in particular the type and quantity of Goods, Buyer’s data, Delivery method, and Payment method.

§2 General Provisions

These Terms define the rules for using the Store, placing Orders, concluding Agreements, making Payments, Delivery, exercising the right of withdrawal, submitting complaints, and using Electronic Services.

Agreements are concluded in Polish.

The Terms and Conditions are made available free of charge in the Store in a way that allows downloading, reproduction, and storage.

The Seller conducts retail sales via the Store.

Information presented in the Store (including product descriptions, images, prices, and availability) constitutes an invitation to conclude an Agreement within the meaning of the Civil Code, unless mandatory law provides otherwise.

The Seller makes every effort to ensure that product descriptions, images, and parameters are accurate and up to date. Differences resulting from the Buyer’s device settings (e.g., screen display) do not constitute non-conformity.

Prices are gross prices in PLN unless stated otherwise.

Prices do not include Delivery costs unless indicated. The total cost is shown before placing the Order.

In case of price reduction, the Seller informs about the lowest price from the 30 days prior, if required by law.

Key terms of the Agreement are confirmed by:
a) making these Terms available,
b) providing an Order summary,
c) sending Order confirmation via email.

The Seller may limit sales to selected territories.

The Buyer must use the Store lawfully and in accordance with good practices.

Providing unlawful content is prohibited.

§3 Technical Requirements and Electronic Services

To use the Store, the following are required:

  • internet-enabled device

  • up-to-date browser with cookies and JavaScript

  • active email address

The Seller provides:

  • browsing the Store

  • Cart functionality

  • Order placement

  • Account (if available)

  • Newsletter (if subscribed)

Services are free of charge.

The Account and Newsletter are provided for an indefinite period and may be cancelled at any time.

The Order service agreement is concluded when the Buyer starts using the Order form and ends when the Order is placed or abandoned.

The Seller ensures proper Store functioning and resolves technical issues within a reasonable time.

Complaints regarding electronic services may be submitted as per §10.

§4 Account and Login Details

The Buyer must provide accurate data and keep login credentials confidential.

The Seller may block the Account in case of violations.

§5 Orders and Conclusion of the Agreement

Orders can be placed 24/7.

To place an Order, the Buyer:

  • selects Goods

  • chooses Delivery and Payment

  • provides required data

  • accepts Terms

  • confirms Order with payment obligation

Placing an Order constitutes an offer.

The Agreement is concluded when the Order is successfully placed.

The Seller may contact the Buyer if issues arise.

If fulfillment is impossible, the Buyer will be informed and refunded.

§6 Payment Methods

Available methods include:

  • Shopify Payments (Stripe)

  • Tpay

  • Klarna (including deferred/installments)

  • other methods available in the Store

Payment operator terms may apply.

Order processing begins after payment confirmation.

Unpaid Orders may be cancelled.

§7 Delivery

Delivery is handled by carriers.

Costs and delivery times are shown before ordering.

Maximum fulfillment time is 30 days unless stated otherwise.

Risk transfers upon delivery.

§8 Right of Withdrawal

The Buyer may withdraw within 14 days without giving a reason.

Returns must be sent within 14 days.

The Buyer bears return costs unless stated otherwise.

Refunds are made within 14 days.

§9 Liability for Conformity

The Seller is liable for non-conformity for 2 years.

The Buyer may request repair or replacement.

If not resolved, the Buyer may request price reduction or withdrawal.

§10 Complaints

Complaints may be submitted:

  • by post

  • by email

The Seller responds within a reasonable time.

§11 Personal Data and Cookies

Data is processed in accordance with GDPR and Privacy Policy.

Data may be shared with service providers (payments, logistics, IT, etc.).

Cookies are used in accordance with applicable law.

§12 Out-of-Court Dispute Resolution

The Buyer may use mediation, arbitration, or consumer protection bodies.

Participation is voluntary.

§13 Changes to Terms

The Seller may amend Terms for valid reasons (legal, technical, operational).

Changes apply prospectively.

§14 Final Provisions

Polish law applies.

Nothing limits mandatory consumer rights.

Terms enter into force upon publication.
